just a quick update for you all.

After all this time we go to court next week for the verdict.

We are hoping it will be in our favour, of course, As we are so fed up witht he whole thing now.

It has cost soooooooomuch money.

And these stupid people are still doing stupid things...anyone want to buy an apartment in turkey?

I will let you all know next week what happens..thank you

hello folks.

I would like to start by saying a big thank you to everyone that gave me support 2 years ago when all this started.

At last our ordeal is over..and hopefully we can get on with our lifes.

The judge has thrown the case out of court, But if we get taken to court for the same thing in 5 years he will jail us for 10 months and we will have a 2000 lira fine!!

Turkish logic..as we never done anything in the first place, but stand up to a bully and a evil woman, and her stupid husband.

So at the end of the day these people need to pay their own fee's and can get no money from us!

Phew!! there is a god after all..xx

If the Judge gave you a 10 month suspended sentence and a suspended fine, it suggests that the case was not thrown out of court and actually you were convicted...

You should get the written judgement properly translated, because if you were convivted you have the right to appeal either to the local upper court or to the supreme appeals court in Ankara. By not appealing you are accepting the verdict, and if you are ever convicted on any (intentional)offence, be it threat, insult, GBH, etc you will be taken to prison, no matter what sentence you get for the 2nd offence.

Be very careful, If your neighbour even presses charges that you called him a nasty name, with a couple of witnesses, things could get very nasty.

Sorry to give bad news but I am concerned that you may have been mis-informed.

Karen, I have put some thought into this matter and whilst Kaspaul got the 10 month bit wrong I do agree with what he had written. Yes I can understand that it is possible to take it the other way and see it as a threat but in this case I feel sure the post was made with the best of intentions and they were only trying to help you.

The judge whilst he may have found you not quilty of the charges did obviously have some concerns and felt the need to record the fact that "But if we get taken to court for the same thing in 5 years he will jail us for 10 months and we will have a 2000 lira fine"So whilst "suspended sentence" may not be the right legal term I do understand what he meant as this punishment, if carried out will be in reference due the original court case.

I think the Caspaul was only pointing out the need to be careful about your neighbour and the risk involved. Also he was right in pointing our that your lawyer should have appealed against the 5 year time line as you were found innocent but will now have that hanging over your head for the next 5 years. Hopefully you got a translation of all the court documents as well, but it may now be too late to appeal. CasPaul in my opinion did give you some good advice.

i have just got back from turkey after being deported for no good reason , i had just arrived in Atalanta, i had an argument with a turkish couple on the pane where they were moved away , they waited till we arrived in turkey to start another argument (due to it being their country) where they cause a big scene and claim i had hit one of them(which i didn't) and also claim i said 'f**k turkey and i hate turkey' (which i didnt)after being jump on by 10 security guards i was taken to the airport police station and taken from one police station to another having my finger prints taken and photo i was eventually left in a cramp deportation cell for four days, still with no1 explaining or letting me contact the British embassy or a translator .

After five days of being locked up i was finally given a chance to contact the British consulate who inform me that the turkish guy claim i had hit him in the face (which i didn't) i had though it would be easy to prove my innocent by them simply checking the cctv in the airport but i had obviously been already found guilty by the police with no court process and they had got the wheels rolling on deporting me which i had to pay for and also pay for a police officers flight to escort me on the plane.i have never been in trouble with the police in the uk or anywhere else in the world and i had been felt to be a criminal and kept locked up for a week. can anyone tell me what i can do to clear my name and also get my money back????

If the consulate was unable to help you, I really don't know what to suggest adam other than telling your story to a Turkish lawyer but I don't hold out much hope. You can see from this thread how difficult dealing with law is here. Getting into arguments is definitely not a good idea.

we were being nice to these people trying to see why they were not talking to us and they went crazy, when they would not listen to us, my partner did threaten to "knock his block off" .

Maybe I have got the wrong end of the stick, but it seems to me that it was you and your husband who started this spat by going to the other couples house and arguing with them. Why would you bother with them if they did not want to talk to you?

As far as I am aware, the Police would do the normal investigation into what happened and common sense would play a part in that.

Injuries from a fall from a bike should look a bit different to those caused by kicks and punches, in my experience.

Are you saying that the Police are numpties/totally stupid and flung your husband out of Turkey for doing nothing more than shouting at another Ex Pat?

Sorry, but I find that a bit hard to believe.

Emekli.... I never said we went to their house at any time on this forum, we were entering the building when this man came in and pushed past my husband and he started shouting when my husband asked him what the problem was.

I feel I now need to up date this forum, last year I applied for my residency again as the 3/6 month visa was of no use to me, I had to go to the court to get clearance papers, which I got without a problem.

It was explained fully to me by a lawyer in the court what the verdict was or in this case "no verdict"

Apparently the judge did not make a decision. So the file gets put in a aside for 5 years.

There is no suspended sentence.

This is why they could not appeal the desision or get money from us, as there was no desision made.

I take it you have had wrong information given to you else where?

To make it clear to you, my husband was cleared of assault straigh away by the pf. as the accuser had no injuries and was lying, he was only in the court as they said he had entered their home. The witness for them said she seen my husband punching him on the floor out in the stairs, he said he had him pinned to the wall and punching him their she did not see him in their home and she did not see me hitting the woman. Then she cried and said she didn't want to say anymore!? Quite obvious she was telling lies, she also tried to read of a paper what had happened and the judge told her to put the paper away.

I have the papers to prove this.

She said I had beat her, but she had not injuries on the front, she only had a superfisal bruise to her but and back of arm. For goodness sake if I beat her up she would have been black and blue. All over. And in intensive care. (I'm twice her size).

And the doctors report stated this was inconsistent.

We did to start anything, these people were after money, he even told a friend they wanted to sell our apartment for money.

They got a friend who had a friend. The police station to organise it all.

We have since been told by the police involved that this was true.

And they apologized to us.

Justice provailed in the end

I could go on all day and bore everyone.

We are getting on with our life's now and this is in the past where it belongs.

These people are what you would call bully's and hard nuts at school. Chav,s. and cause problems where ever they go.

I am only here because a friend told me about your posting.

I thank everyone on this forum that did not judge us.

And strange why kaspaul only made one posting on the date he joined and has not been back since. Mmm
