Please help.... Overstay in Turkey Ikamet

Hi everybody, I have a problem and I search help for find a solution, soon if it's possible !! 

 

I am french, I was coming in Turkey with my Identity card, so when I have ask, 2 months later for make a Ikamet, of course, they say me, no you need a passeport. I go Ankara make it, I wait, 1 month. I am in trouble, I have a overstaying for few days. They say me, if you want make a Ikamet, go out and come back, pay the fine, and ask for make Ikamet. But I was not sure, because the french consulat say me I have to wait 3 months for come back..... I start to become anxious, I don't know who belive, I have a rent home every months, a dog here adopted in the country, a lot of stuff, my job depend of here too (but not directly), and I want live here.....  So, I wait, I search solutions..... I don't really find, I am now a long time in a big deal, overstaying 2 months next month..... I ask Istanbul buro for foreign of the website, they answer me, go out and come back, if you pay the fine, you can after make your Ikamet, they give you ten days for make it, without ban or problems ??

 

Can I trust ?? Did I need a avocat ?? Did I need a help from French Ambassade ?? I am really lost, but if I go out, (I really want and need my Ikamet :/) and have to stay 3 months outside, it's not possible for me, really, I want pay all, I want make all good, but I can't actually go out, so I stay and go out when I can wait a time ban if no solutions, but I really hope and think solutions is possible, I don't know what to do. If I can go out one day and turn back, and have my ten days for make all, it's really what I need/want, or better, pay in the country, don't go out. It's hard I am so sad :/.

For clarification, I mention that ikamet is a residence permit. Contact the French embassy or consulate again. Ask them to call the General Directorate for Migration Management for you, and have them ask if you can just pay a fine for the overstay.

 

I was in a similar situation as an American, also in Izmir. I had overstayed my residence permit by 70 days. I was planning to pay the fine at the port, then go to the Greek Island of Kios for the day, then come back on a tourist visa again.

 

When I went to leave, the immigration official told me I had to leave and not return for 90 days.

 

A friend of mine told me I should call the US consulate in Izmir, and I did. The consular official called the foreigners' bureau (which was under the police at the time), explained my situation, and asked if I could just pay a fine and renew my residence permit.

 

They said yes, that I just needed to pay the fine, and apply for a new residence permit.

 

I don't know if this would work in your case, because you are here with an ID card. But it is worth a try. One of the main things I learned from my experience is that you have to ask the right question to the right person to get what you need.

 

So ask your consulate to call for you, explain that the overstay is a result of you trying to comply with the law, and have them ask specifically if you can just pay the fine and apply for your residence permit. And ask them to get the name of the person they talked to. That way if there are any problems, that person will be personally familiar with your situation.

Hi, Thanks a lot for your answer !! Hum, I have call the french consulat in Izmir, (before I post here) and they have me say, they can't make anything for me, I can maybe ask the buro of immigration to find a solution but they don't belive a lot so they say me, I have to wait 3 months...... Really I don't know what to do, you have say what for have help ?? So maybe I have to call Ambassade in Istanbul, or Ankara, or maybe in France ?? If it's not possible, what can I do ??

 

You think an avocat can be a good help ?? 

Thanks a lot again, I am really sad and tired about the situation. I don't understand why it's so hard, if people pay fine and overstay just a little (not years), for make a IKAMET, why they don't accept, if a tourist overstay it's normal he have to wait, because he don't make is residence permit after, but in this situation, what it's the big deal for the country, I really feel me like a criminal, but I make anything bad !!

Hi Kassia, I can't offer much advice but I can say don't worry you're not alone. My RP expired on the 15th due to the new system change overs. If you think a lawyer can help you talk to a few immediately, preferably someone who is an immigration specialist. But beware you may receive empty hope even from them.

 

I'm going to go to the new bureau this week and see what they have to say about my situation. I had a randevu setup for July in the old system, my only problem is I have been planning to goto the states for a couple of weeks for work purposes in June or early July.

The difference is probably because people with a residence permit have been approved to live here, and make Turkey their home. If you are just here on a visa or an ID card, you only have permission to enter Turkey and stay here for a certain amount of time. But then you have to leave. 

 

If you don't have a residence permit, there may be nothing that can be done and you will have to leave. Whether you can come back immediately or not I don't know, but people from Europe with a tourist visa cannot stay in Turkey for more than 90 days in any 180-day period. So if you have been in Turkey for 90 days, you will probably have to leave Turkey and stay out for another 90 days, and then you can come again for another 90 days in a new 180-day period.

 

RSDunya you replied as I was writing this... I think there is going to be a difference in the situations, since you have an RP and live in Turkey, whereas Kassia is here in a tourism status without a residence permit. I hope you will post what you learn from the GDMM about your situation.

Hi, Thanks again !! Yes I understand the difference, but I will make a redidense permit it's why I stay and overstay, because I have take a rent home for this, I have prepare my money etc etc !! I understand for a tourist, yes I am it too, I have to go, but I want make a residente permit, so I have to know if I go out, can I really come back one day after and have my ten days, if I pay the fine, like say the immigrate buro in Istanbul for foreign people ?? Can I trust ?? :s 

I really don't know what to do, where  I can find the informations, If I can't come back 3 months, I am in a real big problem, and I can't take my dog now, I have to wait his vaccin are ok etc, for a long time, I can't let my rent home, I have a contrat for one year (for make my Ikamet) I have prepare a lot of things for my job,

I have buy staff for my home, I have make a lot sad.png.........

In 2012 i was in turkey as tourist (from italy) and stayed 120 days (over stayed 30 days). At airport the polis fined me 500 turkish lira and banned me for 90 days. When i was back i finally got the residence permit. Sorry to say but there is nothing you can do ... prepare yourself for a 90 days ban ... you can only delay this event by overstaying more days
