Since becoming a member of this forum, I have been trying to gleam as much information as I can regardingdo's and don'ts, scams and tips, taxes and culture/general living laws etc. One area in particular does worry me however and that is Inheritance Law. I did not realise that in Turkish law, should my husband die before me and the tapu being in his name only, I would only receive 25% share of our property and his children (this is our second marriage, albeit 18 years!), would receive 75% share. If I should die before him, he would have 100%. If the tapu was in joint names, my husband would get 100% if I died first, however, if he went first, I would get 50% plus 25% of my husbands share, the remaining share to go to his children (not mine)! If the tapu was in my name only, and my husband went first, then I would have 100%. If I went first my husband would still get 100%. Not very fair methinks.I'm not sure if many non-Turkish home owners are aware of this. As it stands, the tapu is only (or will be ) in my husband's name. Although as our property was recently completed, we held back a small amount for the snagging list, and have instructed our lawyer via POA, to complete on our behalf as soon as the snags have been done but yet to be inspected by a friend. So at this point in time, the tapu has not been processed, I believe. I hope it may be possible to change it to my name only. I wonder how many people are aware of this law. I have also heard that a UK will may not be upheld in a Turkish Court of Law. Or even a will made in Turkey. Perhaps someone can correct me on this subject.J
  2. Hi Joe, If your lawyer is the same as mine (Legal Independence), then you should hear from him soon. I believe he has been away but will be back in Bodrum tomorrow (Wed). You could also ring him - we have done this in the past. He is a very busy man!

  4. Hi Joe, I think you are right to be concerned. We too were in the process of buying at 'The Village' on Phase 2. We signed up last May 2010 and were told that the property (one bed apartment) would be ready in March 2012. On our recent visit to our other property in Akbuk (now fully completed), we popped over to see the Village and were very dismayed at the current situation. Although Phase 1 is built, ie, villas and apartments, the pools, pool bar, all other facilities are not finished and from what we saw, I don't even think that all the properties were sold, many of them still seemed completely empty inside and the outside rubble here and there made it look like a deserted lot. The builders may not have the money to finish Phase 1 properly. This is only our opinion. Kamal may know more if he lives there. Back to Phase 2. The builders had not even started any building as of May this year and they are not allowed to build during the summer months i.e during the tourist season other than inside painting and decorating. When we contacted our lawyers they told us that the builders have not yet received the building license to proceed with construction for Phase 2. Although they may possibly do so at a later stage (depending on how many properties they can sell). As we did not want to wait a further year or two and, having our money albeit paid in stages to be tied up for so long, we asked our lawyer if we could pull out, even at this stage. Fortunately, our lawyer had been putting our money into an escrow account and had not paid it over to the developers until they received notification of the building license. So our money was safe at least. Also, we did not realise that the contract we signed could be cancelled but we would lose our initial £2000 deposit. We were happy to pull out and have now got our money back. In Turkey contracts are only valid if they are notarised by a public notary, which ours were not. Very few are so it is much easier to cancel without penalty. So long as your lawyer is a good one there should be no problem. On the other hand, you may well be prepared to wait for the developers to obtain the building license - there is nothing to suggest that they are in anyway dishonorable other than they are having problems marketing and selling Phase 2, and it could take much longer for it to come about. That is probably why you cannot contact anyone easily, the developers website has disappeared and advertising only on third party agents and of course no pictures (We have been advised by several people 'in the know', that building licenses do not take long to be granted, therefore warning bells started ringing - hence we pulled out).
